1. Acceptance of Terms

By accessing or using PNGmaker ("the Service", "we", "us"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service. These Terms apply to all visitors and users of PNGmaker, including users of the website and API.

2. Description of Service

PNGmaker is a free, browser-based image processing platform that provides tools including background removal, image compression, format conversion, resizing, and other PNG-related utilities.

All image processing runs entirely in your browser. Your images are never uploaded to our servers, transmitted over the network, or stored by PNGmaker. The Service is provided free of charge for personal and commercial use via the web interface.

3. Use of the Service

You may use the Service for any lawful purpose. You agree not to:

  • Use the Service to process, distribute, or store content that is illegal, harmful, or violates any third-party rights.
  • Upload or process images that infringe on the intellectual property rights of others.
  • Use the Service to distribute malware, spyware, or any malicious code.
  • Attempt to scrape, crawl, or systematically extract data from the website in a manner that exceeds reasonable personal use.
  • Circumvent, disable, or interfere with security or access control features of the Service.
  • Use the Service in any way that could damage, overburden, or impair our infrastructure.
  • Misrepresent your identity or affiliation when requesting API access or contacting us.

We reserve the right to restrict or terminate access for users who violate these Terms.

4. Intellectual Property

You retain full ownership of your images. PNGmaker does not claim any rights over images you process using the Service. Because processing is browser-side, your images never leave your device, and we never access or store them.

The PNGmaker platform itself — including its code, design, branding, and content — is owned by PNGmaker and protected by intellectual property laws. You may not copy, reproduce, or redistribute any part of the platform without our prior written consent.

5. User Accounts

PNGmaker may offer optional user accounts to access additional features (such as usage history or saved preferences). If and when account functionality is enabled:

  • You are responsible for maintaining the security of your account credentials.
  • You agree to provide accurate information when creating an account.
  • You are responsible for all activity that occurs under your account.
  • We store only the data necessary to operate your account (see our Privacy Policy).

Account functionality is currently inactive. These provisions apply when accounts become available.

6. API Access

Access to the PNGmaker API is available by request and subject to the following:

  • API usage must comply with these Terms and any additional API-specific terms communicated at the time of access.
  • You may not use the API in ways that would overload or degrade the Service for other users.
  • Fair use applies. Excessive or abusive API usage may result in rate limiting or revocation of access.
  • PNGmaker reserves the right to revoke API access at any time, with or without notice, for violations of these Terms or for operational reasons.
  • You may not redistribute or resell API access to third parties without our explicit written consent.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights. By using the Service, you agree to the collection and use of data as described in that policy.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. PNGmaker does not warrant that:

  • The Service will be uninterrupted, error-free, or available at all times.
  • Results produced by the Service (e.g. background removal, compression) will meet your specific requirements or expectations.
  • The Service will be free of bugs, viruses, or other harmful components.

You use the Service at your own risk. We recommend keeping backups of any images you process.

9. Limitation of Liability

To the fullest extent permitted by applicable law, PNGmaker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or images.
  • Loss of profits or revenue.
  • Business interruption.
  • Any damages resulting from your use of or inability to use the Service.

This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise) and even if PNGmaker has been advised of the possibility of such damages.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

11. Governing Law

These Terms are governed by applicable laws to the extent required. Nothing in these Terms limits your rights under applicable consumer protection or data protection laws, including the General Data Protection Regulation (GDPR) where applicable.
